Welcome to NovelaMax. These Terms of Service ("Terms") govern your access to and use of the NovelaMax website, applications, and related services (collectively, the "Service"), operated by NovelaMax Ltd. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you must have consent from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

You may need to create an account to access certain features. You agree to provide accurate, current and complete information during registration and to keep it updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorised use.

3. License to Use

NovelaMax grants you a limited, non-exclusive, non-transferable, revocable license to stream content solely for personal, non-commercial use. This license is subject to your compliance with these Terms. We reserve all rights not expressly granted.

4. Content and Intellectual Property

All content available on NovelaMax, including but not limited to movies, series, live streams, graphics, logos, and software, is owned by or licensed to NovelaMax and protected by copyright, trademark and other intellectual property laws. You may not copy, distribute, modify, create derivative works, publicly display, or exploit any content without prior written permission.

User-generated content, such as comments or profile pictures, remains your property. However, by posting you grant us a worldwide, royalty-free license to use, reproduce and display that content in connection with the Service.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any local, national or international law.
  • Attempt to circumvent any security, digital rights management, or geo-blocking measures.
  • Use automated tools (bots, scrapers) to access or collect data from the Service without our express permission.
  • Interfere with the proper working of the Service or impose an unreasonable load on our infrastructure.
  • Share, sell, or otherwise transfer your account credentials.

6. Subscriptions and Payments

Certain content or features may require a paid subscription. All fees are displayed in the applicable currency and are non-refundable except as required by law or as explicitly stated. We reserve the right to change subscription prices with reasonable notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

7. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by NovelaMax. We assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that NovelaMax shall not be liable for any damage or loss caused by your use of any such external resource.

8. Termination

We may suspend or terminate your account at our sole discretion if you breach these Terms or engage in conduct that we believe harms other users, the Service, or third parties. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. NovelaMax does not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall NovelaMax, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to defend, indemnify and hold harmless NovelaMax and its affiliates from any claims, damages, losses, liabilities, costs or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya. You agree to attempt to resolve disputes informally by contacting us first before initiating legal action.

13. Changes to These Terms

We may modify these Terms at any time. When we do, we will revise the "Last updated" date at the top. We may also provide additional notice, such as a banner on the website or an email. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you disagree, please stop using the Service.
